Abstract

This article aimed to analyze the principles of legality and proportionality in the crime of violence against police authority in Metropolitan Lima. To do this, a sample survey of 42 lawyers specializing in criminal law and criminal procedure was used and the analysis of a criminal sentence selected for convenience. A survey was applied that used a rating scale for the Likert-type questionnaire. It was found that when the population attacks the police authority, the response of the criminal judges to these events at the time of sentencing the aggressors is based on the extraordinary plenary agreement No. 1-2016, which states that the penalty should not exceed three years, leaving in many cases impunity, which violates the specific law itself that maintains that the penalty should be eight to twelve years. Every criminal judge must sanction with the substantive criminal law, because if he applies the plenary agreement he is violating the principle of legality and proportionality, leading to an increase in common and organized crime
